Lawsuit claims attorney neglected to file claims for over six years

When a person retains the services of an attorney to represent them in an important civil matter, they have a right to expect that they will be provided with diligent and effective representation.

Aside from fighting to protect the rights of their clients and building the strongest possible case, this means attorneys must also make sure that they abide by all applicable rules and procedures. To illustrate, consider a recent case from the East Coast, where a man has filed just such a lawsuit, claiming that his former attorney and the law office for which he worked failed to file his legal claims in a timely manner.

According to the complaint, the plaintiff retained the services of the attorney to represent him in two separate legal matters — one concerning medical malpractice and the other concerning wrongful termination — back in March 2006. However, it goes on to state that from this time through March 2013, both the attorney and his law office failed to file the plaintiff’s claims within the applicable statutes of limitation.

The complaint argues that this failure to file either one of the claims within the necessary timeframe resulted in the plaintiff’s inability to move forward with either legal action causing him a substantial loss for which he is now seeking compensatory damages.
